Eligibility

1. Personal and program eligibility criteria for all Smart and Skilled Programs except Smart and Skilled Entitlement Apprenticeships and Traineeships Program

1.1 Personal eligibility criteria

A person who is eligible to receive Subsidised Training in all Smart and Skilled Programs except Smart and Skilled Entitlement Apprenticeships and Traineeships Program is a person who, at the time of Enrolment in an Approved Qualification:

(a) either:

(i) lives or works in NSW (determined by postcode of the usual place of residence or place of work); or

(ii) lives in a defined interstate NSW border area (as identified by a postcode in the list set out in the Operating Guidelines – see Proof of Eligibility) and is Australian Aboriginal or Torres Strait Islander; and

(b) is:GeneralStudy_921jpg.jpg

(i) an Australian citizen; or

(ii) a permanent Australian resident; or

(iii) a humanitarian visa holder; or

(iv) a New Zealand citizen; and

(c) is aged 15 years or older; and

(d) is no longer in secondary education; and

(e) complies with any relevant program eligibility criteria outlined in clause 1.2 of this Schedule 2 and is not subject to the exemption set out in clause 1.4(a) of this Schedule 2.

1.2 Smart and Skilled Entitlement Full Qualifications Program and Smart and Skilled Entitlement Foundation Skills Program

(a) A person who has a Post-school Qualification at Certificate IV level or higher is not eligible for Subsidised Training for the Smart and Skilled Entitlement Full Qualifications Program or the Smart and Skilled Entitlement Foundation Skills Program

(b) Despite clause 1.2(a), if a person acquires a disability after completion of a Post-school Qualification at Certificate IV level or higher and needs to retrain in a new entry level career and provides evidence that the Qualification is necessary as part of a program of rehabilitation and that the injury was sustained after achieving the Post-school Qualification then the person will be eligible to receive Subsidised Training in that Qualification

1.3 Smart and Skilled Entitlement Apprenticeships and Traineeships Program

A person who is eligible to receive Subsidised Training in the Smart and Skilled Entitlement Apprenticeships and Traineeships Program is a person who:

(a) at the time of Commencement in an Approved Qualification is an Apprentice or New Entrant Trainee and has a Training Contract; and

(b) has the Approved Qualification shown on their Training Contract.

1.4 Exceptions

Despite clauses 1.1, 1.2 and 1.3:

(a) if a person is approved or registered as an Existing Worker Trainee, they will not be eligible to receive Subsidised Training in an Approved Qualification that is associated with the Training Contract for their existing worker traineeship; in relation to any Smart and Skilled Program; and

(b) the Department may, in absolute discretion, allow a Provider to treat a person who does not fit any of the personal or program criteria set out in clauses 1.1, 1.2 or 1.3 as eligible to receive Subsidised Training

2. Personal and program eligibility criteria for School Based Apprenticeships and Traineeships Program

A person who is eligible to receive Subsidised Training in School Based Apprenticeships and Traineeships Program is a person who:

(a) at the time of Commencement in an Approved Qualification is approved or registered as a School Based Apprentice or School Based Trainee in NSW; and

(b) has the Approved Qualification shown on their Training Contract.
